Evaheld Memorials Terms of Service

Agreement and operator

These Terms govern evaheldmemorials.com and its memorial services, operated by After I Go Pty Ltd t/a Evaheld (ABN 80 656 838 505), 608 Harris Street, Ultimo NSW 2007, Australia. By creating an account, purchasing a plan, contributing content or using the service, you agree to these Terms and our Privacy Policy. Contact us at [email protected].

Accounts and authority

You must provide accurate information, protect your login and promptly notify us of unauthorised access. You must be at least 18 to open an account. When creating a memorial, you confirm that you are entitled to provide its content and make decisions about its publication, privacy and contributors.

Memorial content and licences

You retain ownership of content you submit. You grant Evaheld a non-exclusive, worldwide licence to host, reproduce, format, process and display that content only as needed to provide, secure, improve and support the memorial service. You are responsible for permissions relating to photographs, recordings, quotations, personal information and other material you upload.

Respectful and acceptable use

You must not upload unlawful, fraudulent, defamatory, threatening, hateful, exploitative, privacy-invasive or infringing material; impersonate another person; interfere with security; scrape or abuse the service; distribute malware; or use memorials for misleading commercial promotion. We may remove content, restrict publication or suspend access where reasonably necessary to protect people, comply with law or enforce these Terms.

Public memorials, private memorials and contributions

Organisers choose memorial visibility and are responsible for reviewing content before public publication. Public memorials may be indexed and shared beyond Evaheld. Private links must be shared carefully. Contributors must submit authentic, respectful material. Depending on the selected plan, organisers may invite contributors, approve or remove submissions and control publication settings.

Plans and prices

Current Evaheld Memorials plans are priced in Australian dollars and are one-time purchases unless the checkout clearly states otherwise:

• Free Online Memorial — $0 AUD: a public memorial page with written condolences, memories, QR access and sharing tools.
• Shared Tribute Memorial — $199 AUD: collaborative tributes, contributor invitations, media uploads, privacy and moderation tools.
• Memorial Plaque & Tribute — $399 AUD: Shared Tribute features plus two QR memorial plaques.
• Funeral Tribute Memorial — $499 AUD: the digital memorial, two QR plaques, funeral booklet and funeral tribute video features.

The live Plans page forms part of these Terms and controls if a feature or price changes before purchase. Taxes, inclusions and availability are shown at checkout.

Payments, guarantee and refunds

You authorise our payment provider to charge the displayed total. Paid Evaheld Memorials plans include the published 60-day money-back guarantee. Contact us within 60 days to request a full refund. Nothing in these Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.

QR plaques and delivery

Plans that include QR plaques include worldwide standard delivery at no additional shipping charge. You must provide a complete and accurate delivery address. Production and delivery estimates are not guarantees and may be affected by destination, customs, carriers or events outside our control. Check a plaque and its destination before permanent installation.

Availability, preservation and changes

We work to keep memorials available for the long term, but maintenance, security incidents, third-party outages and legal requirements can affect access. We may improve or replace features while preserving the core value of the purchased plan. Users should retain original copies of important media and records.

Liability and indemnity

To the extent permitted by law, Evaheld is not liable for indirect or consequential loss arising from user content, external sharing, unauthorised use of a link, third-party services or circumstances beyond reasonable control. Our liability is not limited where doing so would be unlawful. You agree to indemnify Evaheld against claims arising from content you were not entitled to provide or your unlawful use of the service.

Termination, changes and governing law

You may stop using the service and delete memorials through available account controls. We may suspend or terminate access for serious or repeated breaches, legal obligations or security risk, with reasonable notice where practicable. We may update these Terms and will publish the effective date. These Terms are governed by the laws of New South Wales, Australia, subject to mandatory rights in your jurisdiction.
